Civil Litigation - Mr. Berg has successfully defended a client accused of embezzling over $300,000. It was Greg’s careful and meticulous examination of hundreds of exhibits and potential witnesses, including a few surprise witnesses during the week of trial that led to his success. After a trial, the Court entered an order against the Plaintiff and in favor of Mr. Berg’s client on all counts.
Criminal - A client, who had previously been convicted of a felony and had multiple subsequent misdemeanor convictions, retained Mr. Berg to defend the client from a pending felony DUI charge. Despite repeated attempts by the prosecution to have Mr. Berg’s client serve jail time of at least 12 months in prison, Mr. Berg successfully negotiated a probation sentence allowing his client to keep his job and his home-life intact.
Secretary of State/Driver’s License Reinstatement - A gentleman who had his license revoked since the early 1990’s had previously been rejected for a license reinstatement after a formal hearing with the Secretary of State. After reviewing his case, Mr. Berg created a new strategy for a second formal license reinstatement hearing. By implementing this strategy, Mr. Berg and his client reviewed his prior history and prepared for his reinstatement hearing. Working together as a team, Mr. Berg and his client were successful in reinstating the client’s driver’s license.
Bankruptcy - The majority of bankruptcy cases go smoothly and lack the courtroom drama seen on television. The smoothness a client experiences, however, is the result of preparation and hard work. There are a few cases, though, where surprises will crop up. In one instance Mr. Berg filed a Chapter 7 bankruptcy for a couple whose income was in a legal-gray area that put them in the zone between a Chapter 7 (liquidation) and Chapter 13 (partial repayment plan). For clients in this income bracket there is no guarantee that they could proceed as a Chapter 7, but we decided to take a calculated risk. The United States Trustee’s Office raised the issue of filing an objection to the Chapter 7 and forcing the client to convert to a Chapter 13. By knowing the specific circumstances of his clients’ case, Mr. Berg was able to convince the US Trustee’s Office to not file an objection and allow his clients to receive a discharge under Chapter 7. This couple was able to complete the Chapter 7 and not have to repay those debts.
Criminal - Mr. Berg successfully obtained supervision for a client charged with aggravated battery as a juvenile. While still on the supervision, the same client returned a year later as an adult charged with a criminal offense and a petition to revoke the supervision based upon the new offense. Mr. Berg once again hit a home run on behalf of his client. After investigating and preparing for trial, Mr. Berg answered ready for trial and the prosecution, unable to prove their case, was forced to dismiss the charges. The prosecution re-evaluated their juvenile petition to revoke supervision and decided to withdraw its petition to revoke supervision for the juvenile case.
